Biafra: Chief Judge rejects Justice Nyako’s recusal from Nnamdi Kanu’s trial

The Chief Judge of the Federal High Court, Justice Tsoho has reportedly refused to accept Justice Binta’s recusal from the trial of Nnamdi Kanu, a pro-Biafra agitator.

Justice Tsoho also returned the case file to Nyako to continue handling Kanu’s case.

A source spoke to the Daily Post on Friday, October 11, 2024, about the reasons for Justice Tsoho’s refusal.

The source mentioned “that 2 other judges were previously recused from the case, and that the case has lingered for too long since 2015. The case has pended most with Justice Binta, thus making her the most suited or best placed judge to handle and conclude the case.

However, the Chief Judge has also directed that if, at the next hearing of the case, Nnamdi Kanu still insists on recusing Justice Binta, he must file a written motion with an affidavit, stating all the grounds for requesting the recusal.”

During Kanu’s last appearance in court, Justice Nyako recused herself from the trial following the agitator’s demand, stating that he lacked confidence in Nyako’s ability to handle his case.


In 2021, Nnamdi Kanu was rearrested in Kenya and extradited to Nigeria to face charges of terrorism.
