On Monday, October 24, a Federal High Court in Calabar pronounced Bassey Otu to be the All Progressives Congress' (APC) legitimate candidate for governor in Cross River State in the upcoming 2023 election.

In his decision on the complaint Owan Enoh brought to contest Otu's nomination, Justice Ijeoma Ojukwu stated that political parties still have the right to choose their governorship candidate.

Enoh further stated, "A candidate for the job of governor must be a Nigerian, meet the established age criteria, and have basic qualification in accordance with the Constitution."
