Alleged defamation: Associates call for Farotimi’s release

Associates of detained human rights lawyer, Mr. Dele Farotimi, have called for his immediate release, asserting that his rights have been violated.

In a statement issued by Mr. Taiwo Akinlami on behalf of the group, the associates expressed deep concern over what they described as a troubling disregard for procedural fairness and the rule of law in Farotimi’s arrest and detention.

The statement, titled “Unlawful Arrest and Detention of Mr. Dele Farotimi: A Call for Justice,” outlined alleged irregularities in the arrest of the lawyer, who is also the author of Nigeria and its Criminal Justice System.

The group said: “We, the associates of Mr. Dele Farotimi, a distinguished author and legal practitioner, are deeply troubled by the blatant violations of his rights following his recent arrest and detention. This press release is issued to highlight the irregularities surrounding his case and to demand his fair treatment and prompt release in accordance with the law.”

Farotimi’s legal troubles stem from defamation claims linked to his book. Despite his willingness to address the allegations through legal channels, the associates described his arrest and detention as reflecting a disregard for due process.

According to the statement, Farotimi was first invited by the Nigeria Police Force, Zone 2 Command, in connection with a defamation petition on November 11, 2024. He honored the invitation on November 13 and again on November 21, each time accompanied by his lawyer. On both occasions, he cooperated fully and was allowed to leave.

However, the situation escalated when police officers reportedly began targeting Farotimi’s associates and staff to coerce his surrender.

On December 3, 2024, officers accompanied by a private individual alleged to be the chief security officer for a private citizen in Ekiti State, invaded Farotimi’s Lagos law office. This operation, described by the group as unlawful, involved the arrest of Farotimi, alleged assaults on staff members, and the confiscation of their phones.

Farotimi was subsequently transported across several states, including Lagos, Ogun, Oyo, Osun, and possibly Ondo, before arriving in Ekiti State. The lack of coordination with police commands in these states was cited as evidence of irregularity in the operation.

The Ekiti State Commissioner of Police later admitted that Farotimi was arrested for “criminal defamation,” an offense reportedly expunged from the laws of Lagos State in 2011 and Ekiti State in 2021.

The associates noted that these events have disrupted Farotimi’s preparations for multiple civil suits filed during his detention and caused significant distress to his family, particularly his 76-year-old mother, who recently lost another child.

The associates condemned the alleged misuse of state resources and called for an investigation into the circumstances surrounding Farotimi’s arrest and detention.

The immediate release of Farotimi on bail.

Adherence to the principles of due process and a fair trial.

The group concluded:

“This case is a test of the integrity of Nigeria’s justice system. We urge all individuals and organizations committed to justice, fairness, and the rule of law to join us in advocating for Mr. Farotimi’s rights and freedom.”
